Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Goodze mobile application (the "App") operated by Goodze ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Service Description

Goodze is an AI-powered home inventory management application that allows you to:

• Scan and catalog personal belongings using AI-powered image recognition.
• Organize items by room, category, and custom collections.
• Track warranties, purchase dates, and estimated values.
• Generate itemized inventory reports for insurance purposes.

The App is provided as a tool to assist with home inventory management. AI-generated information (including item identification, categorization, and value estimates) is provided for informational purposes only and may not be fully accurate. You are responsible for verifying the accuracy of all information.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18 (or the age of legal majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. Account Registration

• You may sign in using your Google account. You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate information and to promptly update your information if it changes.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at legal@thegoodze.com if you suspect unauthorized use of your account.

4. User Responsibilities

When using the App, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms.
• Not upload content that is illegal, infringing, defamatory, or harmful.
• Not attempt to reverse engineer, decompile, or disassemble any part of the App.
• Not use the App to store or transmit malicious code or malware.
• Not interfere with or disrupt the integrity or performance of the App.
• Not access the App through automated means (bots, scrapers) without our written permission.
• Not misuse AI features by submitting content that violates third-party rights.

5. Intellectual Property

5.1 Our Property

The App, including its design, features, code, graphics, and AI models, is owned by Goodze and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or proprietary technology.

5.2 Your Content

You retain ownership of all photos, data, and content you upload to the App ("Your Content"). By using the App, you grant us a limited, non-exclusive license to process, store, and display Your Content solely for the purpose of providing and improving the App's services. We will not use Your Content for advertising or share it with third parties except as described in our Privacy Policy.

6. Subscriptions & Payments

6.1 Free & Premium Tiers

Goodze offers a free tier with basic features and a premium subscription ("Goodze Pro") with additional capabilities. Features available in each tier may change over time.

6.2 Billing

• Premium subscriptions are billed through the Apple App Store or Google Play Store (the "Platform").
• Subscription fees are charged at the beginning of each billing period (monthly or annually, depending on your selected plan).
• Prices are displayed in your local currency and may include applicable taxes.

6.3 Free Trials

If offered a free trial, you will not be charged until the trial period ends. You may cancel before the trial ends to avoid being charged. Unused portions of a free trial are forfeited upon purchasing a subscription.

6.4 Cancellation & Refunds

• You may cancel your subscription at any time through your Platform's subscription settings.
• Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until then.
• Refunds are handled by the respective Platform in accordance with their refund policies.

7. AI-Generated Content Disclaimer

The App uses artificial intelligence (Google Gemini) to process images and generate item information. You acknowledge and agree that:

• AI-generated results (item names, categories, descriptions, value estimates) are approximations and may contain errors.
• Value estimates are not professional appraisals and should not be relied upon as the sole basis for insurance claims, financial decisions, or legal purposes.
• You are solely responsible for reviewing and verifying all AI-generated content before using it.
• We are not liable for any losses arising from reliance on AI-generated information.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the App will be uninterrupted, error-free, or secure.
• In no event shall Goodze, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or related to your use of the App.
• Our total aggregate liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Goodze and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any third-party rights.

10. Termination

• You may stop using the App and delete your account at any time through the App's settings.
• We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, if we reasonably believe you have violated these Terms.
• Upon termination, your right to use the App ceases immediately. Sections 5, 7, 8, 9, 11, and 12 survive termination.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Goodze regarding the App.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the App.
